What happens if the paying spouse manipulates income to reduce spousal support?

In Virginia, when a spouse is ordered to pay spousal support, they are expected to abide by that order. If the paying spouse manipulates income to reduce spousal support, they could be held accountable for their actions. The court would investigate if the paying spouse’s income had been unreasonably reduced, and if they were able to pay the ordered spousal support. This could be done by examining the financial documents of both spouses. The court could then determine if there had been a pattern of reducing income to avoid paying the ordered spousal support. If the paying spouse is found to have purposely reduced their income to avoid paying spousal support, they could be given a contempt of court citation and/or ordered to pay additional penalties. Additionally, the court might change the spousal support order to match the paying spouse’s actual income. If the paying spouse is found to be manipulating income, they should be aware that the court will take action.
