How do I amend my tax return?

If you need to amend your tax return in Virginia, you must file an amended return in order to make corrections or changes. Depending on the type of change you need to make, you should use the appropriate form: 1040X (amended U.S. individual income tax return) or 1041X (amended U.S. Estate and/or Trust income tax return). You must file your amended Virginia return using the same form that you originally submitted. To amend a return, you must complete the form 1040X or 1041X and attach a copy of the original return plus copies of all supporting documents (such as W2s or other forms). On the form, enter the information from your original return and enter the changes you are making. Include any additional taxes you are unable to pay with your form 1040X or 1041X; you will receive a bill in the mail. You must also provide a written explanation of the changes you are making or why you are amending the return. You should include a completed Form 760PY (Virginia Part-Year Resident or Nonresident Income Tax Payment Voucher) if you owe additional taxes. All amended returns must be mailed or hand-delivered to the Virginia Department of Taxation. The amended return must be filed within 3 years from the due date of the return (including any extensions) or within 2 years of the date on which you paid the tax, whichever is later.
