What is the Digital Millennium Copyright Act?
The Digital Millennium Copyright Act (DMCA) is a federal law that was passed in the United States in 1998. It was designed to protect the rights of copyright holders in the digital age. It has two main sections: Section 512 and Section 1201. Section 512 deals with online service providers (OSPs), such as websites, that host content. The DMCA limits the liability of OSPs for copyright infringement if they follow certain steps, such as removing infringing material when notified by the copyright owner. Section 1201 addresses digital rights management (DRM). The DMCA makes it illegal to bypass DRM protection technologies and to share DRM circumvention tools. This section also prevents the alteration of copyright notices. In Washington, the DMCA applies to all residents, regardless of whether the copyright holder or OSP is based in the state or not. If you believe your copyright has been infringed upon, you can file a copyright infringement lawsuit in Washington. Ultimately, the purpose of the DMCA is to protect creators and copyright holders from digital copyright infringement. It is an important law in the digital age and has been adopted by all fifty states. If you are an online user or creator, it’s important that you understand the provisions of the DMCA and how they protect you.
