What is the law concerning the transfer of technologies to other countries?
In the state of Washington, laws surrounding the transfer of technologies to other countries are regulated by the International Traffic in Arms Regulations (ITAR). In general, any technology which may be used for military or defense applications is regulated by ITAR and requires permission from the United States government before it can be transferred to another country. The U.S. Department of State’s Directorate of Defense Trade Controls (DDTC) is responsible for administering and enforcing the ITAR and all related laws. The DDTC works with the U.S. Department of Commerce to monitor the transfer of defense-related technologies, materials, and software. They also provide guidance and compliance advice to companies who wish to export technology. In order to export technologies, an exporter must first obtain an export license from the DDTC. Licenses are granted on a case by case basis, and the DDTC reviews the details of each exporter’s proposed export plan in order to determine the appropriateness of the requested technology transfer. In addition, the U.S. government can impose sanctions on companies or individuals who attempt to export technologies to certain countries without obtaining the necessary license. It is therefore important for companies and individuals to familiarize themselves with ITAR before attempting to transfer any technology overseas.
