What are the laws concerning the use of internet of things technologies?
In Texas, the laws concerning the use of internet of things (IoT) technologies depend on the type of technology being used. For example, the Texas Occupations Code regulates the use of drones, and the Texas Penal Code contains provisions related to computer security and unauthorized access. Further, the Texas Business and Commerce Code governs the regulatory implication for the use of IoT in regards to privacy concerns, and the Texas Electrical Safety and Licensing Act governs the use of electrical technologies within the state. Generally speaking, the use of IoT should be legal if it does not violate any existing laws, or is not deemed to be a privacy or security risk. With regard to consumer protection, there are a number of laws in place to protect consumers from the potential risks associated with IoT technologies, such as the Electronic Privacy Protection Act, which requires companies to obtain customer consent before collecting consumer data. In addition, while the Texas Anti-SLAPP Law protects individuals from frivolous lawsuits brought by companies for the express purpose of stopping legitimate criticism, it does not protect individuals from liability for any damage they might cause with their use of IoT. Finally, it is important to keep in mind that the federal government also has its own laws related to IoT and their use, which may also need to be considered when utilizing such technologies in Texas.
