What is the law concerning the development and use of unmanned aerial vehicles (UAVs)?
In North Carolina, the development and use of unmanned aerial vehicles (UAVs) are regulated by state law. UAVs, also known as drones, are aerial vehicles that are remotely operated and are not manned by a physical pilot. In North Carolina, there are several laws that govern the use of UAVs. All operators in the state must comply with the Federal Aviation Administration (FAA) regulations, which restrict the use of UAVs around airports, military installations, and other sensitive areas. In addition, state law prohibits the operation of UAVs without the permission of the property owner where the UAV is to be operated. UAVs must also remain far away from and at least 400 feet above any persons or public gatherings, except in cases of emergency. UAVs are not allowed to be flown over any correctional facilities or nuclear or hydroelectric power plants. UAVs must be operated in a lawful manner that does not interfere with emergency services, or cause harm to persons or property. Individuals looking to use a UAV for commercial purposes must obtain a Certificate of Waiver or Authorization from the FAA prior to doing so. Any person who violates these laws can be subject to criminal prosecution and fines. Therefore, before operating a UAV in North Carolina, the operator should thoroughly understand the laws that govern the use of UAVs in the state. Understanding and following the law will ensure that your UAV is operated safely and legally.
