In Texas, there are laws pertaining to the protection of trade secrets related to technology. Texas recognizes commonly known trade secrets, such as formulas, patterns, programs, processes, techniques, methods, and even customer lists, as trade secrets. Trade secrets must be kept confidential by the individuals possessing them, and any disclosure of such secrets without authorization is prohibited. Texas has adopted the Uniform Trade Secrets Act (UTSA) which outlines protections for trade secret holders and outlines any remedies available to them if the trade secret is misappropriated, such as injunctive relief or damages. In addition, Texas has criminalized the theft or misappropriation of trade secrets, punishable by up to 10 years in prison, a $10,000 fine, or both. Recently, Texas has also adopted the Defend Trade Secrets Act of 2016, which enforces criminal penalties for trade secret theft. Under this act, a trade secret holder may also sue any individuals who commit trade secret theft in federal court. Victims of trade secret theft may also be able to collect damages and/or obtains injunctive relief. Overall, Texas provides trade secret holders with a variety of protections against technology-related trade secret theft. They have criminalized the theft or misappropriation of trade secrets, and have also adopted the Uniform Trade Secrets Act and Defend Trade Secrets Act of 2016 to offer holders with additional protections.
