What is a trustee?

A trustee is a person or entity who is legally responsible for managing assets that have been placed in a trust. A trust is a legal arrangement that allows a person (the settlor) to transfer the ownership of their assets to a trustee for the benefit of another person or group (the beneficiary). In Alaska, trustees are responsible for collecting, protecting, and transferring assets as well as managing any investments related to the trust. Trustees must also ensure they follow any instructions left by the settlor regarding how the trust should be managed. Trustees must act in the best interests of the beneficiaries when managing the trust assets. This means that they must act in a prudent and reasonable manner, as if they were managing their own assets. They must also follow Alaska state laws and regulations related to trusts and estates, as well as any instructions left by the settlor. Depending on the type of trust, the trustee may need to get the permission of the court or other parties before making certain decisions. Trustees are also responsible for keeping accurate and detailed records, and providing information to the beneficiaries about the trust and its assets. In Alaska, trustees can be an individual or an entity such as a corporate trust department or bank. When the settlor names a trustee for a trust, they can place restrictions or requirements on the trustee in order to protect the assets and ensure they are managed in the best possible way. This may include bonding requirements, limits on investments, and restrictions on certain activities.
