What is a trustee?

A trustee is an individual or organization charged with managing the property of another individual or organization. In the context of Trusts and Estates Law in Virginia, a trustee is responsible for administering a trust. This includes collecting and managing the trust’s assets, properly investing those assets, and distributing the trust’s property to the trust’s beneficiaries in accordance with the trust’s terms and the law. A trustee has many important duties, including the duty to act in the best interest of the trust’s beneficiaries. The trustee is also required to keep the trust’s property separate from his own and must account for all activities regarding the trust’s assets on an ongoing basis. The trustee is responsible for making sure that the trust’s assets are invested prudently, that the trust documents and tax records are maintained, and that the trust’s financial reporting is accurate. If a trustee fails to fulfill his or her fiduciary duties, he or she can be held legally responsible. A court may require the trustee to make up any losses that occur as a result of his or her failure to fulfill his or her duties. In Virginia, a trustee is also required to post a bond to cover any potential losses that may arise. Therefore, a trustee is a person or organization charged with managing the assets of a trust and its beneficiaries. A trustee has a great deal of responsibility and must fulfill a number of duties in order to ensure that the trust’s assets are managed properly and its beneficiaries are taken care of.
