How long does a trademark registration last?
In Massachusetts, trademark registrations last indefinitely, as long as the trademark owner continues to use the trademark in commerce. This means the trademark owner must actively use the mark in connection with the goods and/or services associated with the mark. As long as the trademark owner continues to do so, the trademark registration will remain in effect. A trademark registration can also be renewed indefinitely, as long as it is still in use. The trademark owner must file for a renewal between the 9th and 10th year of the registration, and every 10 years thereafter. During the renewal process, the trademark owner must provide evidence that the trademark is still in use. While the trademark registration is in effect, it gives the trademark owner certain exclusive rights to use the mark for the goods and/or services associated with the mark. This means that no other party can use the trademark in a way that is likely to cause confusion or mislead consumers. Therefore, a trademark registration in Massachusetts can last indefinitely, as long as the trademark owner continues to use the trademark in commerce and renews the registration every 10 years or so.
