How long does a trademark registration last?
In New York, a trademark registration lasts for ten years. During this time, the registered trademark is legally protected against infringement. After ten years, the trademark must be renewed to continue protection. The process of renewal must occur every ten years, or the trademark registration could lapse. The U.S. Patent and Trademark Office (USPTO) is responsible for reviewing and granting trademark registrations. It also reviews and approves trademark renewals. Renewal applications must be filed within six months before an existing trademark registration is set to expire. If the application is not received before that date, the trademark will lapse. Once filed, the USPTO reviews the renewal application to make sure that the trademark is still being used in commerce. The USPTO may also request additional information or documents from the applicant. Once approved, the trademark is renewed for another ten years. It is important to keep in mind that, while a trademark registration lasts for ten years, it does not guarantee exclusive rights for that period of time. In order to keep a trademark registration active, the trademark must be continuously used in commerce. If it is not used, it can be challenged and potentially canceled.
