What is the difference between state and federal trademark registration?
State and federal trademark registration are two different ways to protect a trademark. A trademark is a word, phrase, logo, design, or other sign that helps identify a brand and distinguish it from its competitors. State trademark registration is through the state of Massachusetts. State trademarks are protected within the state, but not beyond. For example, if a company in Massachusetts registers its trademark in the state, it will only be protected from other companies in Massachusetts that are using the same or similar trademarks. Federal trademark registration is through the United States Patent and Trademark Office (USPTO). This level of protection is much broader, and covers the entire United States, as well as some foreign countries. By registering the trademark on a federal level, the trademark owner can take legal action against anyone who uses the same or a similar trademark, whether they are in Massachusetts or not. Another difference between state and federal trademark registration is the time frames involved. It can take up to a year for a trademark to be approved by the USPTO. However, it usually takes less than six months to register a trademark in Massachusetts. Finally, the cost of registering a trademark also differs. Registering a trademark with the USPTO is expensive and can cost up to several thousand dollars. By contrast, registering a trademark in Massachusetts is much more affordable and can cost as little as $100.
