How do I transfer trademark ownership?
If you want to transfer trademark ownership in Washington, one of the first steps you’ll need to take is to update the owner information in the database maintained by the United States Patent and Trademark Office (USPTO). This database contains records of all federally registered trademarks. To update the trademark’s owner information, you’ll need to file a document called an Assignment of Ownership – this document transfers title of the trademark from one party to another. Your Assignment of Ownership must include a list of the trademark’s elements (for example trade name, logo, slogan, etc.) and must be filed with the USPTO. Once the USPTO receives and processes the document, the new owner information will be updated in the USPTO database. The second step in transferring trademark ownership is to record a Certificate of Transfer with the Washington Secretary of State. This document must include the name of the holder, the trademark’s elements, and the date of the assignment. This document is important because it creates a public record – it shows proof that ownership of the trademark has been transferred from one party to another. Lastly, if you own trademarks in other countries, you’ll also need to record the Certificate of Transfer with the trademark office in those countries.
