How do I obtain a federal trademark registration?
In order to obtain a federal trademark registration in Indiana, the individual or company must first conduct a trademark search to make sure their desired name or logo is unique and does not infringe upon another company’s existing trademark. This can be done by searching the United States Patent and Trademark Office (USPTO) website for identical or similar marks. If the desired trademark is in-use or registered, then the individual or company must choose a different trademark. Next, the individual or company must file an application with the USPTO. The application must include the name or logo of the desired trademark, proof of the trademark’s use in commerce (which could include photographs, labels, or advertising materials), a signed statement affirming the trademark’s ownership, and the appropriate filing fee. After the USPTO receives the application, they will review it and provide a Certificate of Registration if it is approved. This certificate is tangible proof that the trademark is legally protected. It is important to note that a federal trademark registration does not guarantee exclusive rights to the trademark; it merely grants the trademark holder the right to take legal action against infringers within the United States. If the individual or company desires to protect their trademark outside of the United States, they must also file for trademark protection in other countries.
