How do I transfer my trademark to another company?
Transferring a trademark to another company is a complicated process that requires that certain legal requirements be met. In Washington, the transfer of a trademark is outlined in Chapter 19.77 of the Washington Administrative Code (WAC). In order to transfer a trademark to another company in Washington state, the transferor and the transferee must both agree to the transfer and sign a written agreement. The written agreement should include the name and contact information of both the transferor and transferee, the date of the transfer, and a description of the trademark being transferred. The transferor must also provide the transferee with a copy of the trademark registration and any other documents related to the application or registration of the trademark. In order for the transfer to be valid, it must be recorded with the U.S. Patent and Trademark Office (USPTO). The transferor must provide the USPTO with the required documents, including the written agreement and any other supporting documentation, and pay the appropriate fee. Once the transfer has been approved by the USPTO, the transferee will then become the legal owner of the trademark and will have all the rights and obligations associated with owning the trademark.
