What is a trademark opposition proceeding?

A trademark opposition proceeding is a legal proceeding that takes place in California when two parties have a dispute over a trademark. In the proceeding, the parties (typically a company or individual who registered the trademark and another who wants to oppose it) present evidence and arguments to a Board of three members. The Board then decides whether to grant or deny the trademark registration. The most common type of trademark opposition is a claim of “likelihood of confusion”, where the party opposing the trademark argues that the use of the mark would likely confuse consumers and cause them to mistakenly believe that the goods or services offered come from the same source. Opposition proceedings can be very complex and costly. In California, they are conducted in front of the Trademark Trial and Appeal Board, part of the United States Patent and Trademark Office. The proceedings involve written briefs and often in-person hearings, and may take months or even years. The outcome of a trademark opposition proceeding in California is determined by a three-member Board, who make a decision based on the facts and evidence presented by the parties involved. The Board considers the similarity of the marks, the commercial relationship between the goods and services, and other factors. Ultimately, the Board decides whether the trademark registration should be granted or denied.
