How can trade secrets be enforced?

Trade secrets can be enforced through legal action, such as civil litigation. In Virginia, the owner of a trade secret can bring a civil action against an individual or business for misappropriation. The owner of the trade secret must prove that the secret was, in fact, a trade secret and that it was misappropriated. Additionally, the trade secret must have been misappropriated, either prior to or during the litigation. If a court rules that the trade secret was misappropriated, the damages that the trade secret owner may recover can include money damages and/or an injunction ordering the defendant to stop using the trade secret. In order to protect and enforce trade secrets, it is important for businesses to take all necessary steps to keep their trade secrets confidential. This includes maintaining records of the trade secrets and taking steps to limit access to the trade secrets. It is also important to have employees sign confidentiality and non-disclosure agreements regarding the use and dissemination of trade secrets. Taking these steps can help protect a business’s trade secrets and make it easier to enforce them in the event of misappropriation.
