What are the requirements for a trade secret claim?
To make a successful trade secret claim in Washington, a few requirements must be met. First, the information must meet the definition of a trade secret. To qualify, the secret must have commercial value due to its secrecy and reasonable steps must be taken to keep the information confidential. The secret must also be something that is not public knowledge. Second, the claim must demonstrate that the secret was misappropriated. Often, this occurs when information is acquired by someone who had or should have had knowledge that it was a trade secret and was disclosed without the owner’s consent. Third, the claim must demonstrate that the misappropriation was the result of improper means. These may include theft, bribery, or breach of confidentiality. Finally, the claim must demonstrate that the wrongdoer benefited in some way from the misappropriation of the trade secret. This can be shown through the acquisition of a competitive advantage or the use of the secret to gain profits or financial gain. Once all of these criteria are met, a valid trade secret claim can be brought before a court in Washington. The court can then decide if the trade secret was in fact misappropriated and if the wrongdoer benefited from the misappropriation. If the court finds in favor of the claim, it can award damages, and the wrongdoer may be compelled to stop using the trade secret immediately.
