Is there a difference between a trade secret and a trademark?

Trade secrets and trademarks encompass two different types of intellectual property. A trade secret is information that is valuable because it is not generally known and is kept secret. This could include formulas or processes for making a product, or even customer lists. In Massachusetts, trade secrets are protected by the Uniform Trade Secrets Act. On the other hand, a trademark is a recognizable sign, design, or expression which identifies products or services of a particular source from those of others. It can be a word, phrase, symbol, or even design. A trademark does not need to be kept secret; in fact, trademarks are meant to be promoted and used in business. In Massachusetts, trademarks are protected by both state and federal laws. Both trade secrets and trademarks are considered forms of intellectual property and they are both used to help businesses protect and promote their products or services. The main difference between the two is that a trade secret is kept secret, while a trademark is used to identify different products or services.
