What types of damages are available in the United States for trade secret misappropriation?
In the United States, damages for trade secret misappropriation can come in different forms. These damages can compensate the rightful owner of the trade secret for any financial losses that were suffered due to the misappropriation. The most common form of damages is compensatory damages, which are intended to put the owner in the same financial position they were in before the trade secret was misappropriated. In Massachusetts, the courts may also award exemplary damages, which are meant to punish the wrongdoer for his or her misdeeds and to deter further misconduct. The amount of exemplary damages awarded is usually higher than the amount of compensatory damages. In addition, the courts may award attorneys’ fees to the victor in some cases. The court may also issue an injunction, which is an order from the court that would prevent the wrongdoer from using or disclosing the trade secret. In some cases, the court may award a royalty payment, which is a set amount of money that must be paid for the use of the trade secret. These damages are generally meant to compensate the rightful owner for his or her loss of future profits due to the misappropriation. Finally, the courts may issue a disgorgement of profits order, which would require the wrongdoer to return any profits that were improperly obtained as a result of the misappropriation. This is intended to restore the rightful owner to the financial position that he or she would have been had the misappropriation never taken place.
