An administrative hearing for a traffic ticket is a legal proceeding in which a person who has received a ticket for a violation of a traffic law can contest the ticket. Virginia Administrative hearings are conducted by the Department of Motor Vehicles (DMV) and presided over by a hearing officer. At the hearing, the ticketed person (the petitioner) has the opportunity to explain why they believe the ticket should be dismissed, or the fine reduced. To do this, they may present evidence, such as witness testimony, photos, and documents. The hearing officer will then take into consideration the evidence provided and make a decision regarding the outcome of the hearing. Ultimately, the hearing officer will either uphold the ticket, reduce the fine, or dismiss the ticket entirely. If the ticket is not dismissed, the ticketed person may still have the option to appeal the decision to the local court of law or challenge the ticket in court. Whether or not the petitioner is successful at the hearing, they will generally need to pay the ticket in order to keep their driving record clean and avoid future complications. In some cases, the hearing officer may provide the petitioner with a payment plan to help with the financial burden.
