What is the time limit for contesting a traffic ticket court decision?
In South Carolina, you have a certain amount of time to contest a traffic ticket court decision. According to the South Carolina Code of Laws (§ 15-39-830), a person who has been found guilty by a magistrate, municipal judge, or court of general sessions must file an appeal within 10 days of the guilty judgement. The appeal is then filed with the clerk of the court. If the person is appealing to the circuit court, then they must also provide a copy of the appeal to the solicitor’s office or the magistrate’s office within 10 days from the filing of the appeal. Additionally, a request for a new trial must be made within 10 days of the guilty judgement as well. The request should be made in writing and the reason for the request must be stated clearly. For appeals to the circuit court, the solicitor’s office must be provided with a copy of the request no more than 14 days after the judgement. It is important to note that the time limit for contesting a traffic ticket court decision is strict. If the appeal or request for a new trial is not filed within the aforementioned timeframes, the guilty judgement will stand.
