What is the time limit for contesting a traffic ticket court decision?
In the state of Virginia, a person has 30 days from the date of the traffic ticket court decision to contest it. The intent to contest must be made in writing, and sent to the clerk of the court where the hearing was held. In the written appeal, the person must state why the decision was wrong. The appeal must also include either a check or money order for payment of the appeal fee. If the traffic ticket court decision is appealed, a new hearing will be conducted in the same court where the original decision was made. The purpose of the new hearing is to review the original decision, and determine if the decision should stand. The court may accept evidence from both sides and hear testimony from witnesses. After the new hearing is completed, the court will make another decision, which can either be changed or upheld. A person who does not contest the decision within the time limit of 30 days may face significant legal consequences. The court may impose fines, suspend the person’s driver’s license, or require the person to take a driver education course, depending on the individual circumstances. Therefore, it is important to make an appeal within the time limit of 30 days in order to ensure that any legal consequences are minimized.
