What is false advertising?
False advertising is a type of unfair competition law that prohibits deceptive or misleading advertisements. It is illegal in Massachusetts for an advertiser to make false or untrue claims about their product or services. These claims can be either about quality, characteristics, benefits, or pricing, and they must not mislead the consumer. For example, a company cannot claim that its product can cure a disease, even if the company believes that their product can do so. Similarly, an advertisement cannot mislead consumers about the cost of a product by not including additional costs or fees. Misleading consumers about pricing can also include offers that cannot actually be fulfilled. Furthermore, false advertising can include products or services that are misrepresented as a different type of product or services. Companies cannot advertise a product as being environmentally friendly or 100% natural if it is not. Companies have to honor their warranties, and they cannot make false statements about their products or services. False advertising is a serious issue in Massachusetts, and it is illegal because it creates an uneven playing field between competitors. It can also lead to a loss of consumer confidence and decreased sales. Companies violating false advertising laws can be subject to hefty fines and criminal prosecution. Consumers should always research a product or service before purchasing to avoid being tricked by false advertising.
