What is the Sherman-Kleptomania Doctrine?

The Sherman-Kleptomania Doctrine is a legal doctrine that was adopted by Florida courts to protect Florida businesses from unfair competition from other businesses. It was named after the two attorneys who drafted it, Sherman Shanley and Kleptomania. The doctrine allows businesses to seek relief from a court if they believe another business has unfairly competed with them by offering cheaper prices or otherwise taken advantage of them. If the court finds that the other business has acted unfairly, it can award the affected business a monetary judgment and order the other business to stop its unfair practices. The doctrine is based upon the concept that free competition is essential to a well-functioning economy. Allowing businesses to compete freely allows the best products and services to rise to the top. If a business is allowed to take unfair advantage of its competitors, consumers will suffer, as they will have fewer choices and higher prices. The doctrine is important to Florida business owners, as it helps protect them from unfair competition. It also provides them with a way to seek relief from a court if they believe another business has acted unfairly. This can help businesses protect their investments and maintain their competitive advantages in the marketplace.
