What is the purpose of the Uniform Domain Name Dispute Resolution Policy (UDRP)?

The Uniform Domain Name Dispute Resolution Policy (UDRP) is a set of rules created to resolve disputes regarding internet domain names. It is administered by the Internet Corporation for Assigned Names and Numbers (ICANN) and was developed to protect trademark owners from the bad faith registration of their trademarks as domain names. The primary purpose of the UDRP is to protect trademark and service mark owners from internet domain name “cyber-squatting” or “typosquatting”. In other words, the UDRP seeks to prevent the registration of a domain name that is similar or identical to an established trademark. Unscrupulous individuals have been known to register domain names with trademarks in an effort to confuse customers and redirect them to their own websites, essentially hijacking the legitimate business’s traffic. The UDRP also helps to prevent companies from registering domain names with trademarks in bad faith in order to reserve them for future use in an effort to exploit the trademark owner. When a domain name is registered in bad faith, the trademark owner can file a formal complaint under the UDRP to have the domain name transferred to the rightful owner. Finally, the UDRP helps to ensure that domain name registrants abide by the “Responsible Domain Name Practices Guidelines” that protect trademark owners from infringing on the rights of others. Domain name registrants must be mindful of the restrictions and obligations that are set forth in the UDRP in order to avoid potential disputes.
