What is the Federal Trade Commission Act (FTCA)?

The Federal Trade Commission Act, known as FTCA, is a federal law passed in 1914 making it unlawful for businesses to engage in unfair or deceptive practices. This act established the Federal Trade Commission (FTC), an independent agency with the mission to prevent and stop unfair competition in the marketplace. In California, the FTCA is strictly enforced and applies to any business activity taking place within the state that relates to trade and commerce. The FTCA is designed to protect consumers and businesses from unfair or deceptive business practices, including deceptive advertising, bait and switch tactics, false pricing and false labeling. The FTC enforces the FTCA by investigating companies that have been accused of engaging in unfair or deceptive trade practices, and if they find that a company has violated the law, they can issue a warning or fine to that company, and even take legal action against them if appropriate. In addition to enforcement, the FTC can also issue rules and regulations, such as the Endorsement Guides and Green Guides, that guide companies in advertising, endorsements, and environmental issues, to ensure they comply with the FTCA. The FTCA protects businesses and consumers, giving them the confidence to engage in trade and commerce without worrying about being taken advantage of or being misled. It also helps create a level playing field by ensuring that companies compete fairly and that consumers receive accurate information.
