How does the Anticybersquatting Consumer Protection Act protect against unfair competition?

The Anticybersquatting Consumer Protection Act (ACPA) was passed in 1999 and is designed to protect consumers from unfair competition in South Dakota. This law prohibits traders from using a domain name which is confusingly similar to a well-known trademark or one that implies affiliation with the trademark holder. For example, a merchant could not register a domain name such as www.nikeofficial.com if it had nothing to do with Nike. Under the ACPA, a trademark holder can file a lawsuit against a person or organization for registering or using a domain name with bad faith intent to profit from the goodwill generated by the trademark. The law also allows the trademark holder to seek compensatory damages as well as an injunction or court order to stop the cybersquatter from further using the domain name. The law also allows trademark holders to take preemptive action against cybersquatters by filing a complaint with the domain registrar. The domain registrar must take action within 14 days if the complaint is specified according to the ACPA standards. This gives trademark holders the ability to take action quickly against those who attempt to register domain names with the intent to unfairly compete. In addition, the ACPA grants trademark holders the ability to seek a court order to transfer a domain name from a cybersquatter to the trademark holder. This helps to ensure that the rightful owner of the trademark is able to keep control of their brand and protect against any attempts to use the domain name for unfair competition.
