How does the Anticybersquatting Consumer Protection Act protect against unfair competition?
The Anticybersquatting Consumer Protection Act (ACPA) is a federal law that was established in 1999 to protect individuals and businesses from unfair competition online. Under the ACPA, cybersquatting is illegal. Cybersquatting is the registering, selling, or using of another person’s domain name in bad faith to profit off of someone else’s brand. The ACPA protects businesses from someone else gainings rights to their domain name. It also allows a business to take legal action against cybersquatters who register and use a domain name that is the same or confusingly similar to the business’s trademark. If proven, the infringer can be ordered to transfer the domain name to the owner of the trademark or to pay money damages to the owner. The ACPA also provides additional protections to businesses in Virginia and throughout the rest of the United States. For example, the law allows businesses to sue those who register domain names with the intent to either profit off of their trademarks or disrupt their business. Additionally, the ACPA prohibits cybersquatters from falsely claiming a connection to the business they are targeting.
