What is a Uniform Dispute Resolution Policy (UDRP) claim?
A Uniform Dispute Resolution Policy (UDRP) claim is a legal process used to settle disputes regarding domain names online. It is a specific set of criteria created by Internet Corporation for Assigned Names and Numbers (ICANN) to resolve conflicts between domain name registrants and third parties who have a legitimate claim to the domain. When a person or business registers a domain name, they assert rights to that domain. If another individual or business believes they have a legitimate interest in controlling that domain or if they believe the domain is being used in bad faith, they can file a UDRP complaint. This complaint will be reviewed and considered by a panel of experts. The panel of experts will review the facts of the case and make a determination based on the following criteria: (1) whether the domain name is identical or confusingly similar to the complainant’s trademark, (2) whether the registrant has no legitimate rights to the domain name, (3) whether the domain name has been used in bad faith. If the panel of experts finds that the domain name is in violation of UDRP, the domain name registration will be suspended, cancelled or transferred to the complainant. This process is a more efficient and cost-effective resolution in comparison to other legal proceedings. UDRP claims are commonly used in Pennsylvania to settle disputes arising from unfair competition and trademark infringement.
