What is a Uniform Dispute Resolution Policy (UDRP) claim?

A Uniform Dispute Resolution Policy (UDRP) claim is a legal claim brought against a business or individual that is engaging in unfair competition with another business or individual in South Carolina. This type of legal claim is commonly used when one business is using the intellectual property, such as a trademark, of another business without permission. The UDRP is a set of policies managed by the Internet Corporation of Assigned Names and Numbers (ICANN) and the World Intellectual Property Organization (WIPO). It applies to most domain names registered through registrars like GoDaddy and Network Solutions. When an UDRP claim is filed, it is done through an independent third-party organization that specializes in resolving domain name disputes. The organization reviews the dispute and decides whether or not the domain name is being used in a way that constitutes unfair competition. If the organization decides that the domain name has been used in an unfair manner, they will order the domain name holder to transfer or cancel the domain name registration. The UDRP is a cost-effective way to resolve disputes and protect businesses from infringing on other businesses’ intellectual property rights.
