What is the scope of the Anticybersquatting Consumer Protection Act?

The Anticybersquatting Consumer Protection Act (ACPA) is a law created to protect consumers from unfair competition. This law is applicable to South Carolina and is aimed at stopping cybersquatting, which is the practice of registering a domain name containing a trademark that was not previously registered, in order to profit from the sale or misuse of that mark. The ACPA gives trademark owners a way to seek legal recourse against cybersquatters and consumers are protected from having their trademarks misused or taken advantage of by cybersquatters. The act defines cybersquatting as the act of registering, trafficking in, or using a domain name that is identical to, or confusingly similar to, a trademarked name of another person in bad faith. The act also prohibits the use of a domain name that is likely to cause confusion about the source of goods or services. The scope of the ACPA includes provision for damages, attorneys’ fees, and other relief available to the trademark owner as well as other remedies the court may deem necessary. The act also requires a site to be registered before a complaint can be filed. The law also provides a safe harbor for innocent registrants of a domain name. The ACPA serves an important role in protecting consumers by reducing the risk of cybersquatting and the misuse of trademarks. This law allows for trademark owners to enforce their rights against cybersquatters that seek to make a profit from their marks.
