How does the Supreme Court interpret the US Constitution?
The Supreme Court of the United States is the highest court in the land and the only court specifically mentioned in the United States Constitution. The job of the Supreme Court is to interpret the US Constitution and ensure that it is applied fairly across the country. The Supreme Court generally interprets the US Constitution by examining the text of the document and taking into account the intent of the framers who wrote it. The Supreme Court can also look to the practice of other states that have similar laws to its own to help guide its interpretation of the Constitution. When interpreting the US Constitution, the Supreme Court will assess whether any laws, executive actions, or state statutes violate or are consistent with the Constitution. This process is known as judicial review. The Supreme Court has the power to declare a law unconstitutional and therefore invalid. This is known as judicial review since the court is essentially reviewing the law to make sure it is consistent with the Constitution. In the state of North Carolina, the Supreme Court is responsible for interpreting the North Carolina Constitution and deciding whether or not statutes are constitutional. The North Carolina Supreme Court looks at the text of the state Constitution, the intentions of the framers, and the laws of other states to make sure that all laws are in line with the US Constitution as well as the North Carolina Constitution.
