What is the relationship between the US Constitution and international law?
The United States Constitution is the highest law of the land and the basis for the laws of the United States. International law is the body of rules that govern relationships between nations and individuals. While the US Constitution is the highest law of the land, it does not directly address the relationships between countries or individuals outside of the United States. The US Constitution does, however, provide the basis for how the United States interacts and complies with international law. In particular, the US Constitution grants to the federal government the power to make treaties with foreign countries, and these treaties become the "supreme law of the land" just like any other federal law. Additionally, the Constitution grants Congress the power to "define and punish offenses against the law of nations," and this gives Congress the authority to establish laws that are consistent with international law. Therefore, while the US Constitution does not directly address international law, it provides the foundation for the United States to engage in international law-abiding behavior. By establishing the power of the federal government to make treaties, as well as to define and punish offenses against the law of nations, the US Constitution sets the framework for how the United States will comply with international law.
