What is the scope of the right to travel under the US Constitution?
The right to travel is a fundamental right protected by the United States Constitution. It is a right for citizens and non-citizens alike to be able to move freely within the United States and to other countries. The right to travel is protected by the Privileges and Immunities Clause of the Constitution which states that all citizens have the right to “pass freely from one State to another” without interference from the government. In Florida, the right to travel is further protected by the state’s constitution. Specifically, it states that “The right of citizens to travel upon the public highways and to transport their property thereon, by horse-drawn carriage, wagon, automobile, or other vehicle, shall not be abridged or denied.” The scope of the right to travel is broad and encompasses everything from one’s ability to travel within the United States to their ability to visit other countries. However, the right is not absolute and the government can impose certain restrictions on a person’s ability to travel within the US and to foreign countries. For example, in an effort to prevent people from entering the US without proper documents, the government may impose travel restrictions on individuals from certain countries. Additionally, the government may also impose travel bans on individuals that have committed certain crimes or terrorist acts. In Florida, the right to travel is ultimately protected by both the federal and state constitutions. It gives individuals the freedom to travel domestically and abroad without fear of unjust government restrictions.
