How do I appeal a VA disability decision?
If you receive a decision from the Department of Veterans Affairs (VA) denying your claim for disability benefits, you have the right to appeal that decision. The VA allows you to appeal the decision in writing within one year of receiving it. To request an appeal, you must complete VA Form 21-0958 and submit it online or by mail to the VA Regional Office (VARO) responsible for your state. This form is known as a Notice of Disagreement (NOD). You should include any additional evidence or information that supports your claim. Once the VA receives your NOD, they will send you a letter confirming they have received your appeal and what their next steps are. You may be asked to provide additional documentation or attend a hearing to discuss your claim. You may also be called for a medical examination. This will be conducted by a qualified medical professional to assess your current medical condition and to determine if it is related to your service. Finally, the VA will review your claim and decide whether to grant or deny your appeal. This decision is called a Statement of the Case. If you are not satisfied with the VA’s decision, you may appeal it to the Board of Veterans’ Appeals by filing a VA Form 9. It is important to remember that the appeals process can be lengthy and complicated. If you need help navigating the appeals process, you should contact a lawyer or an accredited Veterans Service Organization to assist you.
