What happens if evidence is not provided?
If a veteran in the state of South Carolina is submitting a claim for a disability benefit, it is important that they provide evidence to support the claim. Without evidence, the claim will be denied due to insufficient proof. The evidence could include medical records, service records, laboratory results, or any other supporting documentation that would back up the claim. If the veteran is unable to provide the necessary evidence to support their claim, they may be eligible for an Unemployability Rating. This rating is based on the veteran’s limitations due to the disability and is not based on the severity of the disability itself. The rating is typically used as a last resort when evidence is not available to support the claim. If the veteran does provide evidence, but the evidence is not convincing enough to support the claim, the veteran may receive a lower rating than they originally requested. The rating is determined by the Department of Veterans Affairs (VA) and will be based on how severe the disability is and how much it affects the veteran’s ability to work. In either case, the veteran must always provide some sort of evidence to back up their claim. Without the necessary evidence, the veteran will not receive any benefits and will be left to their own devices.
