What is a waiver of overpayment?

A waiver of overpayment is a legal document that reduces or eliminates the amount of money that a veteran must repay for disability benefits that were paid in excess. This can happen when a veteran receives a higher amount than they were entitled to, or when they receive the same amount for a longer period than they qualified to receive. In New York, the U.S. Department of Veterans Affairs (VA) has the authority to waive overpayments of disability benefits. To be eligible for a waiver, veterans must meet certain requirements. These typically include demonstrating that they did not know they were receiving more money than they were entitled to and that the overpayment was not due to any fault or misrepresentation on the part of the veteran. They must also provide evidence that they are currently experiencing financial hardship. In some cases, the VA may approve a waiver in full or as a partial reduction of the debt. A full waiver eliminates all of the debt and the veteran will not have to pay it back. A partial waiver reduces the overpayment amount to a lower, more manageable figure. Veterans can apply for a waiver by submitting a waiver application to the VA. The application must include proof of financial hardship and a detailed explanation of the reasons why the veteran believes they should have their overpayment waived.
