Yes, you can receive benefits for a pre-existing medical condition in New Jersey under Veterans Disability Law. First, you must prove that the pre-existing medical condition was caused by or aggravated by service in the U.S. military. You must also show that the condition is “severe” and that it affects your ability to work. For a disability to qualify for benefits, the medical condition must create symptoms that substantially limit the veteran’s earning capacity. The condition must are also expected to continue for at least 12 months. If the condition has already lasted for 12 months, the veteran must prove that it is expected to continue into the future. Pre-existing medical conditions may qualify for a 10% or more disability rating, or a higher rating, depending on how severe the disability is.
