What are the requirements for a presumption of service connection?
To receive a presumption of service connection for a disability in California, several criteria must be met. First, the veteran must have served on active duty in the U.S. military. The veteran must have served for at least 90 days, and the last day of active duty must have been during a period of war. This includes World War I, World War II, the Korean War, Vietnam War, Gulf War, and the period of the Global War on Terrorism. Second, while the veteran was on active duty there must have been an in-service event or diagnosis associated with the disability. The event or diagnosis must have been documented in the veteran’s service records. Finally, the veteran must be currently diagnosed with a disability. This disability must be related to the in-service event or diagnosis. The disability must also be rated at 10% or higher on the Department of Veterans Affairs rating scale. If all the criteria are met, then the veteran will receive a presumption of service connection for the disability. This means that the veteran will be eligible to receive VA disability benefits and compensation for the disability.
