What can I do if I disagree with the VA’s decision?

If you disagree with the decision that the Veteran’s Affairs (VA) has made regarding your disability claim in North Carolina, there are steps you can take to appeal the decision. The appeals process involves filing a Notice of Disagreement (NOD) with the VA Regional Office. This must be done within one year of the date of the VA’s decision if you want to pursue the appeal. In the NOD, you must state what decision you disagree with and provide any evidence to support your disagreement. The VA may then look at the facts you presented and decide to change or “reverse” their decision. If the VA doesn’t reverse their decision then your appeal will be forwarded to the Board of Veterans Appeals (BVA). The BVA will review your appeal and may reverse or maintain the original decision. If the BVA doesn’t reverse the decision then you can appeal to the United States Court of Appeals for Veterans Claims (CAVC). The CAVC reviews all legal issues associated with the denial of your disability claim. They may also review evidence that was not considered by the BVA, making it possible that they could reverse the decision. It is important to file appeals in a timely manner to ensure that your rights under veterans disability law are protected. If you disagree with the VA’s decision on your claim, it is important to review and understand the appeals process to ensure that you can pursue the appeal.
