What is a vehicle rollover?

A vehicle rollover is when a vehicle flips over onto its roof or side in an accident. In Virginia, a vehicle rollover accident is governed by the state’s Vehicle Rollover Law. This law holds that all drivers in Virginia are presumed to be at-fault for rollover accidents due to the fact that they are deemed to have acted with negligence or recklessness in allowing such an accident to happen. This law requires that injured individuals prove the other driver was at fault for the rollover accident. In order to prove negligence, the injured party must be able to show that the other driver did something illegal, such as speeding, or drove in a reckless manner. Additionally, the injured party must prove the damages, such as medical bills, lost wages, or other financial losses, were a direct result of the rollover accident. If the injured party is successful in proving their claims, they are entitled to financial damages for their injuries. The amount of the damages will depend on the severity of the injury as well as any economic losses that were attributed to the accident. The court will determine the amount of damages to be awarded, which can include compensation for medical care, property damage, lost wages, and other financial losses.
