What are the restrictions on paying workers under the age of 18?

In North Dakota, workers under the age of 18 are subject to restrictions on the amount of hours they are allowed to work and the type of work they may be permitted to do. The North Dakota Department of Labor and Human Rights requires employers to obtain a work permit from the School Attendance Officer before hiring minors, with the exception of agricultural and domestic labor. For work performed on school days, employers are prohibited from hiring minors until after 3:30 pm. For work performed on school days, the minor may not work more than 3 hours. Additionally, minors are not allowed to work more than 8 hours in any given day, more than 40 hours in any given week, or more than 6 consecutive days. Minors are also subject to restrictions on the kind of work they are allowed to do. Minors under the age of sixteen who are not attending school may not perform hazardous work, which includes work in logging, mining, trenching, the operation of power-driven machinery, and certain types of work performed with power tools. Minors under the age of eighteen are prohibited from working in certain occupations, such as those involving the handling of explosives, the use of intoxicating liquors, and the operation of motor vehicles. Additionally, minors are not allowed to work as door-to-door salesmen, bartenders, or security guards. Minors are also ineligible for overtime pay, and cannot be paid less than the minimum wage ($7.25 per hour in North Dakota). Employers must keep records of the workers’ hours and wages and verify all employees under the age of 18 are working in accordance with the law.
