What is the difference between a common law contract and a contract under wage and hour law?
A common law contract is an agreement between two parties that is based on an agreement reached through negotiation. It is created through an exchange of promises, and each party is expected to follow the terms of the contract. Common law contracts can be oral or written, and there is no requirement for them to be in writing. On the other hand, a contract under wage and hour law is a contract between an employer and employee that is regulated by the federal and/or state laws. In Louisiana, the labor and employment law regulates wage and hour law. Under wage and hour law, the employee has certain rights, such as the right to be paid according to established minimum wage laws, the right to time off for medical appointments, the right to take protected holidays, the right to overtime pay, and the right to family and medical leave. These rights are often given to employees in a written contract in order to protect them from any potential abuses in the workplace. The main difference between a common law contract and a contract under wage and hour law is that the latter provides more protection to the employee since it is based on laws rather than negotiations between two parties. Additionally, contracts under wage and hour law are always in writing in order to ensure the employee’s rights are properly documented.
