What is the difference between overtime hours and double time?
The difference between overtime hours and double time is the amount of compensation paid to the employee. In Delaware, if an employee works more than 40 hours in a workweek, they are eligible for overtime pay, which is 1.5 times their regular rate of pay. However, any hours worked beyond eight in a single day can be paid at double their regular rate of pay. For example, if an employee works a 45-hour workweek, they would be eligible for five hours of overtime, to be paid at 1.5 times their regular rate of pay. In addition, if any of those five hours was worked in a single day, they would be eligible for double time for those hours. There are some exceptions to this rule, however. For example, if an employee is classified as an exempt employee under state or federal wage and hour laws, they may not be eligible for overtime pay. Non-exempt employees, such as transportation workers, are entitled to overtime pay and even double time in some circumstances. In summary, overtime pay is 1.5 times an employee’s regular rate of pay for any hours worked beyond 40 in a workweek. Double time is twice the regular rate of pay for any hours worked beyond 8 in a single day. Exempt employees may not be eligible for either.
