Are there any exceptions to the minimum wage law?
Yes, there are exceptions to the minimum wage law in Louisiana. These exceptions are based on age, student status, and employment type. For example, employers are allowed to pay workers under the age of 20 a minimum wage that is lower than the state rate. The rate must not be lower than $4.25 per hour and may not last longer than 90 days. Student learners who are employed in a bona fide educational training program may be paid a minimum wage that is lower than the state rate. However, employers are still required to pay students at least $1.60 per hour over the regular federal minimum wage. Employees who work on a basis that is other than time spent, such as piecework, may be paid an average rate that is lower than the state rate. In this case, employers must pay employees not less than the applicable state or federal minimum wage for each hour worked. In addition, employers may take a credit of up to $2.13 per hour against the minimum wage in order to cover tips. This applies only in cases where the compensation from tips is sufficient to make up the difference between the wage paid and the minimum wage rate. Finally, some employers are exempt from minimum wage laws, including those who are engaged in agriculture, newspaper delivery, or certain domestic service employment. Overall, there are a few exceptions to the minimum wage law in Louisiana. Some of these exceptions are based on age, student status, and employment type, while other exceptions are based on specific industries or occupations.
