When can employers legally ask employees to work off the clock?

In Louisiana, employers are allowed to ask employees to work off the clock in certain circumstances. Generally, employers may request uncompensated work only if the employee has already been paid for all hours worked during the day or week. Additionally, employers must have the consent of the employee for off the clock work. The Fair Labor Standards Act (FLSA) requires that employers pay all employees a minimum wage and overtime for all hours worked beyond 40 hours in a single week. This applies whether the hours are recorded or not. Therefore, employers may not request that employees work off the clock without compensating them for their work time. Also, employers are not allowed to ask an employee to work off the clock if it would violate any agreement the employer has made with the employee. Furthermore, employers cannot ask employees to work off the clock if the employee is otherwise performing work-related tasks.
