When can employers legally ask employees to work off the clock?

In Mississippi, employers are not legally allowed to ask employees to work off the clock. Off-the-clock work is prohibited by the Mississippi Wage and Hour Law, which states that all employees must be compensated for the time they spend working. The law applies to all non-exempt employees over the age of 18 or any minor employees who are at least 14 years old and are allowed to work. Employers must pay all employees for every hour continuously worked, regardless of whether that time is spent before or after the start of their shift. For example, if an employee is required to attend a meeting or complete paperwork before their shift begins, the employer must pay them for that timeframe. The same goes for any overtime work; in Mississippi, employers must pay at least time-and-a-half for any hours over 40 in a single week. In addition, employers are not allowed to ask employees to work through their meal or rest breaks. If an employee works more than 5 consecutive hours, they must be allowed to take a 30 minute break; this time should be paid as well. Finally, Mississippi employers are not allowed to ask employees to work off the clock in exchange for “tips". Tips are the sole property of the employee, and must be paid separately from their wages. These are the restrictions that Mississippi employers must abide by to ensure they are paying their employees fairly and in compliance with the law.
