What is the False Claims Act?

The False Claims Act (FCA) is an important whistleblower law in Florida. It is designed to protect taxpayers from fraud committed by businesses and individuals. The FCA makes it a crime for a person or company to knowingly make false or fraudulent claims for payment to the government or any of its agencies or departments. For example, if a company bills the Department of Defense for materials it has not delivered, the company could be liable for damages under the FCA. Under the FCA, whistleblowers who become aware of such fraudulent activity can file a “qui tam” lawsuit in the name of the government. If the government is successful in obtaining damages, the whistleblower receives a portion of the recovered funds as an incentive for helping to uncover the fraud. In addition, the FCA provides protections for whistleblowers from job-related retaliation or harassment. The FCA is an important tool for the government to safeguard taxpayer dollars and hold wrongdoers accountable when it comes to fraud and abuse. By encouraging people to come forward and report possible fraudulent activity, it helps to ensure the integrity of government funds and programs. Furthermore, the protection of whistleblowers under the FCA encourages individuals to speak up about fraudulent activities without fear of reprisal.
