What is the Anti-Discrimination/Anti-Retaliation law?

The Anti-Discrimination/Anti-Retaliation law, also known as the Whistleblower Law, is a Washington state law that protects workers from being retaliated against or discriminated against in the workplace due to their whistleblowing or participation in an investigation. The law prohibits employers from retaliating against employees who report employer misconduct to an appropriate authority, such as an enforcement agency, or participate in an investigation involving their employer. The Whistleblower Law is in place to encourage employees to speak up about workplace misconduct without fear of retaliation. It offers protection to those who make a good faith report to the proper authority, even if the report turns out to be untrue. Under this law, employers are prohibited from taking any action against the employee for making such a report, including firing them, denying their promotion, reducing their pay, demoting them, or refusing to hire them in the future. In addition, employers may not harass an employee or threaten them for making a good faith report. If an employer has violated the Whistleblower Law, the affected employee may seek legal counsel and file a complaint with the Washington State Human Rights Commission. The employee may also file a civil action for damages. In certain cases, the employee may also be eligible for reinstatement to their job, back pay, and other remedies.
